Nairobi County Governor Sakaja Johnson Statement on the Arrest of Nairobi County Chief Officer Patrick Analo over allegations of corruption.
The Nairobi City County Government has taken note of the arrest of a county official by the Ethics and Anti-Corruption Commission (EACC) following investigations into allegations of corruption and the recovery of substantial sums of money.
We wish to state that this is a legal process being undertaken by independent constitutional and investigative institutions. The County Government respects the rule of law and will fully cooperate with the EACC and all relevant agencies to facilitate the investigations.
Corruption has no place in public service. Every public officer is individually accountable for their actions and must be prepared to answer to the law where allegations of wrong doing arise. All officers are reminded of this individual culpability as well as their professional responsibilities to their respective professional bodies. At the same time, we remain guided by the constitutional principle that every person is presumed innocent until proven guilty by a court of law.
This administration remains firmly committed to integrity, transparency, accountability, and prudent stewardship of public resources. We will not shield any individual found to have engaged in corrupt practices, regardless of their position or status.
We urge the public to allow the investigative and judicial processes to proceed without interference or speculation. Nairobi residents can be assured that service delivery will continue uninterrupted as the relevant institutions carry out their mandate.
Subsequently, the County Chief Officer Urban Planning, PLAN. Patrick Akivaga Analo, is immediately suspended pending conclusion of the investigation. The officer will not be allowed to access his office or any official documents or systems during this period.
Mr. Dominic Mutegi, the Director of Development Management shall act in this capacity effective immediately.
Further changes in this sub-sector will be announced shortly.
Additionally:
1. The Urban Planning Technical Committee, which processes all development approvals, shall be reconstituted immediately. The County has written to relevant agencies and professional bodies i.e. The Civil Aviation Authority, The Institute of Planners, The Architectural Association, The Engineers Board of Kenya, representatives of Resident Associations, The Nairobi Water and Sewerage Company, et al. for their nominees to this committee. We have further proposed that the EACC provide a liaison officer who will assist in dealing with both the committee and the members of the public on matters Urban Planning and Development Control.
2. All processing of development approvals be suspended until the full reconstitution of this committee. All urgent cases will be handled by the County Executive Committee Member of Built Environment and Urban Planning, Hon. Patrick Mbogo, in accordance to the Physical and Land Use Planning Act. (No. 13 of 2019).
3. Hon. Ibrahim Auma Nyangoya shall act in the capacity of County Executive Committee Member for Finance and Economic Planning effective immediately.
