EABL Statement on Court Dismissal Of Bia Tosha Application To Stop Diageo-Asahi Transaction

The High Court today dismissed with costs an application by Bia Tosha Distributors seeking to stop the proposed Diageo-Asahi transaction.

In its ruling, the Court noted that Bia Tosha is already pursuing the same issues at the Court of Appeal.

The Court reiterated its previous ruling dated 9 April 2026 that Bia Tosha lacked a legal nexus to the share transfer and failed to establish a prima facie case to halt the transaction.

The Court further affirmed that the broader public interest favors allowing the transaction to proceed without disruption.

This decision provides legal clarity on the transaction as it advances through its final regulatory steps.
