A conservatory order on suspending Communications Authority of Kenya’s (CAK) memo which ordered TV and Radio stations in Kenya to stop live coverage of Genz demonstrations. CAK ordered to restore the signals of the TV and radio stations it shut down.


Court Order Suspending CAK Memo to Stop TV and Radio Live Coverage of Demonstrations

THIS MATTER coming up for directions on the Notice of Motion and petition both dated 25th June 2025 before Honourable Justice E C MWITA AND UPON CONSIDERING the pleadings, I am satisfied that they raise fundamental constitutional questions touching on potential violation of the Bill Of Rights in the Constitution and freedom of the Media calling for intervention by this court.

IT IS HEREBY ORDERED:

  1. THAT Pleadings be served immediately through emails due to the urgency of the matter.

  2. THAT the respondents and interested parties do file and serve responses to the application and petition within 3 days after service.

  3. THAT The Petitioners will have 3 days after service to file a rejoinder if need be

  4. THAT Directions on 2nd July 2025

  5. THAT A conservatory order is HEREBY ISSUED suspending, with immediate effect, the DIRECTIVE REF No. CA/CE/BC/TV90A or any other directive issued by Communication Authority of Kenya to all Television and Radio Stations directing them to stop live coverage of the demonstrations of 25th June 2025 or any other demonstrations, until the hearing and determination of the application and petition

  6. THAT Any Broadcasting signals that may have been switched off as a result of the referenced directive be restored with immediate effect, pending further orders of the court.

  7. THAT service of this order may be effected through email and may also be served by publishing it in live Television broadcasts or through newspapers ...
