KRA Statement On Kenya and UAE Agreement in Custom Matters

The Governments of Kenya and the United Arab Emirates (UAE) have established a framework for cooperation and mutual assistance between the Customs Administrations of the two countries to strengthen Customs enforcement, enhance cooperation, and protect the economic, social, and cultural interests of both nations.

The agreement will be particularly crucial in enforcing the Customs procedures and legislations in both countries, providing technical assistance, and exchanging best practices regarding the implementation of trade facilitation measures.

The purpose of the agreement is to combat Customs offences, ensure accurate collection of Customs duties, and address illicit trafficking of goods, narcotics, and sensitive items. The agreement also covers cooperation in preventing and investigating Customs offences, sharing information, developing new Customs procedures, and training of personnel.

Key Provisions of the Agreement:

Definitions: Terms such as Customs Administration, Customs offence, narcotic drugs, psychotropic substances, and sensitive goods have been defined for clarity.

Surveillance: Both parties will monitor individuals, goods, transport, and postal packages suspected of Customs offences or illicit trafficking.

Actions Against Illicit Traffic: Kenya and the UAE will cooperate in combating trafficking of sensitive goods, including drugs, weapons, cultural objects, counterfeit goods, and endangered species.

Exchange of Information: Kenya and the UAE have agreed to share data on Customs value, goods classification, origin, and offences to improve enforcement.

Assistance in Recovery: There will be mutual assistance in recovering Customs claims, subject to national laws.

Investigations: Each party may request investigations into Customs offences, with results shared. Officials from the requesting party may observe investigations but cannot actively participate.

Technical Assistance: This includes training, exchange of expertise, and sharing best practices in Customs control and trade facilitation.

Authorized Economic Operator (AEO): The two countries may by mutual agreement enter into negotiations for Authorized Economic Operator (AEO) mutual recognition agreements.

Amendments: Modifications to the agreement will require mutual consent and written documentation.
